Alongside each family’s personal story, this reality raises a legal question we hear again and again: what happens when an inheritance crosses the ocean? A relative who died in Los Angeles and left a house and other assets. An Israeli parent who owned an investment apartment in Miami or a US stock portfolio. An Israeli heir who finds out they are named in an American will. In each of these cases, two very different legal systems meet.

In this guide we explain, in plain terms, how inheritance works in the US and in California in particular: what probate is, how much it costs, how long it takes, when it can be shortened, and how US estate tax applies to Israelis. Above all, we explain how to plan ahead so your family is spared years of expensive bureaucracy.

Three Scenarios Where Israelis Meet a US Inheritance

An Israeli heir of someone who died in the US: a relative who lived in Los Angeles, New York or any other state died and left assets, such as a house, bank accounts, an investment portfolio or a business. The heirs in Israel need to manage a US inheritance proceeding from a distance.

An Israeli decedent with assets in the US: an Israeli resident died owning investment real estate, US stocks or a US bank account. These assets do not automatically follow the Israeli inheritance order.

A “two-continent” family: some of the children live in Israel, some in Los Angeles, and there are assets in both countries. This calls for planning that keeps the two legal systems in sync. Otherwise, each country pulls in a different direction.

The Key Principle: An Israeli Inheritance Order Is Not Valid in the US

Inheritance law is territorial. An inheritance order or probate order issued by the Israeli Registrar of Inheritance Affairs binds banks and government authorities in Israel only. A US bank, a California real estate brokerage or the Los Angeles County Recorder will not transfer an asset based on an Israeli document. A local US proceeding is required.

The reverse is just as true: a US will or a California court order is not enough on its own to release assets in Israel. We covered the full Israeli process in our guide how an estate is divided in Israel.

Probate in California: What It Is and Why Everyone Tries to Avoid It

Probate is a legal proceeding held in the county court (in Los Angeles, the Superior Court of Los Angeles County). The court validates the will, appoints an estate representative (an Executor or Administrator), gathers the assets, pays debts and taxes, and only at the end distributes what remains to the heirs. Unlike the Israeli process, which in most cases is administrative and relatively fast, US probate is a full court proceeding. It is public, and it takes a long time.

How Long Does It Take?

A typical probate case in California takes between 9 months and a year and a half, and complex or contested estates take even longer. When the heirs are in Israel, every stage that requires signatures, authentications and translated documents adds time.

How Much Does It Cost?

California law sets statutory fees for the attorney and for the estate representative, as a percentage of the gross value of the estate: 4% on the first 100,000 dollars, 3% on the next 100,000, 2% on the next 800,000, and 1% up to 9 million dollars. Each of them is paid separately. On a one million dollar estate, for example, the statutory attorney fee alone can reach about 46,000 dollars, and twice that if the estate representative also takes a fee. Court fees, appraisals and related costs come on top. Keep in mind: the calculation is based on the gross value, with no deduction for a mortgage or debts.

The Shortcut Routes: When You Can Skip Full Probate

California law recognizes that full probate is not justified for small estates, and provides shortcut routes (as of 2026):

Small Estate Affidavit: when all of the decedent’s personal property in California is worth less than 208,850 dollars, accounts and assets can be released with a simple affidavit, with no court involvement at all.

A primary residence worth up to 750,000 dollars: the AB 2016 reform, in effect since April 2025, allows the decedent’s primary residence to be transferred through a shortened proceeding (Petition to Determine Succession). For many Los Angeles families, this is a dramatic saving in time and cost.

Assets with named beneficiaries: retirement accounts (IRA/401k), life insurance and accounts with a beneficiary designation (POD/TOD) pass directly to the named beneficiary, with no probate at all.

US Estate Tax: The Point That Surprises Israelis

Israel has had no estate tax since 1981. The US is very different, and the critical distinction is between a US resident and a nonresident:

A US citizen or resident: enjoys a very high federal exemption, about 15 million dollars per person (as of 2026). The vast majority of estates never owe any tax.

A nonresident (an Israeli) who holds assets in the US: the exemption on US-situs assets is only 60,000 dollars, and the tax on the balance climbs as high as 40%. The IRS requires an estate tax return (Form 706-NA) above the threshold. Real estate in Los Angeles, shares of US companies and even valuables physically located in the US all count as US-situs assets.

There is no estate tax treaty between Israel and the US to soften this rule. As a result, an Israeli who holds significant US real estate or a US stock portfolio without advance planning exposes their heirs to a heavy tax.

One piece of good news: California, unlike states such as New York, has no state estate tax. Only the federal tax applies.

California Is a “Community Property” State, and That Matters for Inheritance

California is one of the few Community Property states in the US: most property acquired during the marriage belongs to both spouses in equal shares, regardless of whose name it is registered in. When one spouse dies, only the decedent’s half passes by inheritance. The surviving spouse’s half is not part of the estate at all. For Israeli couples who lived or live in Los Angeles, this rule completely changes the distribution picture, and it sometimes conflicts with what an old Israeli will provides.

Planning Ahead: The Tools That Save Your Family Years and Hundreds of Thousands of Shekels

Living Trust

This is the central estate planning tool in California. During their lifetime, the person transfers their assets into a trust they fully control. On their death, the assets pass to the heirs with no probate at all: quickly, privately and at low cost. That is why almost every established family in Los Angeles has a trust, and it is a tool every Israeli with real estate in California should seriously consider.

Parallel, Coordinated Wills

If you hold assets in both countries, it is usually advisable to make two coordinated wills: an Israeli will for the assets in Israel and a US will for the assets in the US, drafted so that neither one revokes the other by mistake. A carelessly drafted “revocation of prior wills” clause in one will can wipe out the other. We discussed the rules on revoking a will in a separate guide. Coordinating the wills, including aligning them with the Community Property rules, is the core of the legal work.

Beneficiary Designations and Joint Ownership

Naming beneficiaries on bank and investment accounts (Payable on Death / Transfer on Death), and holding real estate in joint ownership with a right of survivorship (Joint Tenancy), are simple tools that take specific assets out of the probate route. Make sure they are in sync with the will and with the overall tax picture.

Inheritance in Israel vs. California: A Quick Comparison

Parameter

Israel

California

The proceeding

Inheritance order / probate order from the Registrar

Probate in the county Superior Court

Typical duration

A few months (if there are no objections)

9-18 months or more

Cost

Fees and an agreed legal fee

Statutory fees as a percentage of the gross estate

Estate tax

None

No state tax; federal tax with an exemption of only $60,000 for a nonresident

Publicity

Administrative proceeding (usually)

Public court proceeding

Spousal property

Joint ownership presumption / resources balancing arrangement

Community Property: half goes to the spouse automatically

Main planning tool

A will

Living Trust + a will

Frequently Asked Questions About Inheritance and Assets in the US

Is an Israeli inheritance order valid in the United States?

No. Inheritance law is territorial: an Israeli inheritance order or probate order is binding only in Israel. To release assets in the US, a local US proceeding is required: full probate or one of the shortcut routes, depending on the value and type of the assets.

How long does probate take in California?

A typical case takes 9 to 18 months, and complex or contested estates can take years. When the heirs are in Israel, notarized translations, signature authentications and remote coordination add time. That is why it matters to have counsel who knows both sides.

How much does probate cost in California?

The law sets statutory fees for the attorney and for the estate representative: 4% on the first 100,000 dollars of the gross estate value, 3% on the next 100,000, 2% on the next 800,000 and 1% up to 9 million, for each of them. On a one million dollar estate, that means tens of thousands of dollars, before court fees and related costs.

Can probate be avoided?

Yes, with advance planning: a Living Trust that holds the assets, beneficiary designations on accounts (POD/TOD), joint ownership with a right of survivorship, and in California, the shortcut routes for small estates and for a primary residence worth up to 750,000 dollars.

What is the small estate threshold in California in 2026?

208,850 dollars in personal property. Below that threshold, a Small Estate Affidavit can be used without going to court. In addition, since April 2025 (the AB 2016 reform), the decedent’s primary residence worth up to 750,000 dollars can be transferred through a shortened proceeding.

How much estate tax will an Israeli who holds US assets pay?

A nonresident has an exemption of only 60,000 dollars on US assets (real estate, US stocks, tangible property located in the US), and the balance is taxed at rates reaching up to 40%. By comparison, a US citizen or resident enjoys an exemption of about 15 million dollars. There is no estate tax treaty between Israel and the US, so advance planning is critical.

Does an heir in Israel pay tax on an inheritance received from the US?

Israel has no estate tax or inheritance tax, so receiving the inheritance itself is not taxed. However, US estate tax (if it applies) is paid out of the estate before distribution, and future income from the assets received, such as rent or capital gains, must be reported and taxed under the relevant law.

I have assets in Israel and in Los Angeles. Do I need two wills?

In most cases, yes, that is the recommendation: an Israeli will for the assets in Israel and a US will for the assets in the US, drafted in full coordination so that one does not revoke the other by mistake. For assets in California, it is also worth considering a Living Trust, which makes probate unnecessary.

What is Community Property and how does it affect inheritance?

California is a community property state: most property acquired during the marriage belongs to both spouses equally, regardless of how it is registered. On death, only the decedent’s half passes by inheritance. For Israeli couples with ties to California, this rule directly affects how the will is drafted and how the estate is divided.

The heirs are in Israel and the assets are in California. How does this work in practice?

The proceeding takes place in California, but there is no need to fly there. With powers of attorney, signature authentications at the consulate or before a notary, and coordination between an Israeli lawyer and a local California attorney, the entire proceeding can be managed remotely. A single two-continent team that runs the whole process saves duplication, unnecessary translations and mistakes.

What happens if there is no will at all?

The rules of inheritance by law of the relevant jurisdiction apply. In California (Intestate Succession), the estate is divided between the spouse and the children according to the Community Property rules. In Israel, it is divided under the Succession Law, 5725-1965 (Chok HaYerusha). When both systems apply to different assets of the same decedent, the result can be very different from what the family expected. That is one more reason to plan ahead.

Which documents are needed to start handling a US inheritance?

At the first stage: a death certificate (with an apostille if it was issued in Israel), the original will if there is one, an initial list of assets (real estate addresses, accounts, investment portfolios), and the heirs’ details. From there, a strategy is built: full probate, a shortcut route or administration through a trust.

Two-Continent Counsel: Israel and Los Angeles Under One Legal Roof

A cross-continent inheritance is exactly where families lose time and money between two legal worlds. To release assets in the US, a local US proceeding is required: full probate or one of the shortcut routes, depending on the value and type of the assets."}},{"@type":"Question
How long does probate take in California?
@type":"Answer
A typical case takes 9 to 18 months, and complex or contested estates can take years. When the heirs are in Israel, notarized translations, signature authentications and remote coordination add time. That is why it matters to have counsel who knows both sides."}},{"@type":"Question
How much does probate cost in California?
@type":"Answer
The law sets statutory fees for the attorney and for the estate representative: 4% on the first 100,000 dollars of the gross estate value, 3% on the next 100,000, 2% on the next 800,000 and 1% up to 9 million, for each of them. On a one million dollar estate, that means tens of thousands of dollars, before court fees and related costs."}},{"@type":"Question
Can probate be avoided?
@type":"Answer
Yes, with advance planning: a Living Trust that holds the assets, beneficiary designations on accounts (POD/TOD), joint ownership with a right of survivorship, and in California, the shortcut routes for small estates and for a primary residence worth up to 750,000 dollars."}},{"@type":"Question
What is the small estate threshold in California in 2026?
@type":"Answer
208,850 dollars in personal property. Below that threshold, a Small Estate Affidavit can be used without going to court. In addition, since April 2025 (the AB 2016 reform), the decedent's primary residence worth up to 750,000 dollars can be transferred through a shortened proceeding."}},{"@type":"Question
How much estate tax will an Israeli who holds US assets pay?
@type":"Answer
A nonresident has an exemption of only 60,000 dollars on US assets (real estate, US stocks, tangible property located in the US), and the balance is taxed at rates reaching up to 40%. By comparison, a US citizen or resident enjoys an exemption of about 15 million dollars. There is no estate tax treaty between Israel and the US, so advance planning is critical."}},{"@type":"Question
Does an heir in Israel pay tax on an inheritance received from the US?
@type":"Answer
Israel has no estate tax or inheritance tax, so receiving the inheritance itself is not taxed. However, US estate tax (if it applies) is paid out of the estate before distribution, and future income from the assets received, such as rent or capital gains, must be reported and taxed under the relevant law."}},{"@type":"Question
I have assets in Israel and in Los Angeles. Do I need two wills?
@type":"Answer
In most cases, yes, that is the recommendation: an Israeli will for the assets in Israel and a US will for the assets in the US, drafted in full coordination so that one does not revoke the other by mistake. For assets in California, it is also worth considering a Living Trust, which makes probate unnecessary."}},{"@type":"Question
What is Community Property and how does it affect inheritance?
@type":"Answer
California is a community property state: most property acquired during the marriage belongs to both spouses equally, regardless of how it is registered. On death, only the decedent's half passes by inheritance. For Israeli couples with ties to California, this rule directly affects how the will is drafted and how the estate is divided."}},{"@type":"Question
The heirs are in Israel and the assets are in California. How does this work in practice?
@type":"Answer
The proceeding takes place in California, but there is no need to fly there. With powers of attorney, signature authentications at the consulate or before a notary, and coordination between an Israeli lawyer and a local California attorney, the entire proceeding can be managed remotely. A single two-continent team that runs the whole process saves duplication, unnecessary translations and mistakes."}},{"@type":"Question
What happens if there is no will at all?
@type":"Answer
That is one more reason to plan ahead."}},{"@type":"Question
Which documents are needed to start handling a US inheritance?
@type":"Answer
At the first stage: a death certificate (with an apostille if it was issued in Israel), the original will if there is one, an initial list of assets (real estate addresses, accounts, investment portfolios), and the heirs' details. From there, a strategy is built: full probate, a shortcut route or administration through a trust.
["GET
